Your right to recovery in a maritime death case depends on where the death or drowning occurred. If the wrongful death or drowning occurred beyond a marine league from any shore, it is covered by the Death on the High Seas Act, a federal law that provides economic or pecuniary damages for the financial support the deceased person provided. If the death or drowning occurred within a marine league of a shore, the wrongful death law of the adjacent state will apply and you may be entitled to additional damages, including loss of consortium, loss of parental guidance, and even punitive damages. Children, parents, spouses, and in some cases siblings may be eligible for compensation for the wrongful death of their loved one.
